Spybox provides users with remote access to various third-party platforms through our secure servers. These TOS govern your use of our services. By accessing or using Spybox, you agree to be bound by these terms.
2. Service Description
Spybox operates by holding user accounts for various third-party platforms on our secure servers. Users access these accounts through streaming technology or remote server connections. At no point do users have direct access to the login credentials of these accounts.
3. Compliance with Third-Party Terms of Service
Spybox is committed to complying with the TOS of all third-party platforms we provide access to. Users must adhere to the TOS of these platforms. Any activity that violates these terms is strictly prohibited and may result in termination of access.
4. User Responsibilities
By using Spybox, you agree to:
• Comply with the TOS of all third-party platforms accessed through Spybox.
• Use the accounts held by Spybox for permitted activities only.
• Not engage in unauthorized use, sharing of access, or any attempt to circumvent platform security measures.
• Indemnify and hold Spybox harmless from any legal disputes or liabilities arising from actions that violate the TOS of third-party platforms.
• Provide accurate and complete information during registration and update it as necessary to ensure it remains accurate and complete.
• Maintain the confidentiality of any access credentials provided by Spybox and notify us immediately of any unauthorized use of your account or any other security breach.
5. Account Security and Access
Users are granted access to Spybox-held accounts solely for permitted activities. Unauthorized use, sharing of access, or any attempt to circumvent platform security measures is strictly prohibited. Spybox reserves the right to terminate or suspend access to any user found to be violating these terms.
6. Changes to Services
Access to third-party platforms through Spybox is subject to the TOS of these platforms. Spybox reserves the right to alter or discontinue services to maintain compliance with updated platform policies. Users will be notified of any significant changes affecting their access.
7. Dispute Resolution
In the event of a dispute by the owner of one of the software packages, Spybox is 100% ready to listen and address concerns. We have a dedicated email address for such matters: contact@spyboox.io
We are committed to resolving disputes promptly and in good faith.
8. Service Modifications
Spybox makes no commitment to offer software access indefinitely. The catalogue of available software is subject to change based on needs and constraints. If a software package is withdrawn, it will be replaced by an equivalent for 7 days. Such changes do not justify a refund to customers.
9. Refund Policy
Spybox does not offer refunds for changes in the software catalogue, service disruptions, or any other reason. In the event of a significant service interruption or termination, Spybox may, at its discretion, offer prorated credits or other compensation to affected users.
10. Privacy and Data Security
Spybox is committed to protecting the privacy and security of its users. We collect, use, and disclose information in accordance with our Privacy Policy, which is incorporated by reference into these TOS. By using Spybox, you consent to our collection, use, and disclosure practices, and agree to abide by our Privacy Policy.
11. Intellectual Property
All content, software, and materials available on or through Spybox, including but not limited to text, graphics, logos, and software, are the property of Spybox or its licensors and are protected by copyright, trademark, and other intellectual property laws. Users are granted a
limited, non-exclusive, non-transferable license to access and use the services in accordance with these TOS.
12. Indemnity and Liability
Users agree to indemnify and hold Spybox, its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to their use of the services, violation of these TOS, or infringement of any rights of another.
13. Disclaimer and Limitation of Liability
Spybox provides services on an “as is” and “as available” basis. We do not guarantee the availability or functionality of third-party platforms. To the maximum extent permitted by law, Spybox disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Spybox is not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services.
14. Governing Law
These TOS are governed by and construed in accordance with the laws of FRANCE. Any legal actions or proceedings related to your use of Spybox shall be brought exclusively in the courts located in FRANCE.
15. Changes to These Terms
Spybox reserves the right to update or modify these TOS at any time. Users will be notified of any significant changes. Continued use of Spybox after such changes constitutes acceptance of the new terms.
16. Entire Agreement
These TOS, along with the Privacy Policy and any other Notices and Disclaimers published by Spybox, constitute the entire agreement between you and Spybox regarding the use of our services. Any prior agreements, representations, warranties, or understandings are superseded by these TOS.
17. Severability
If any provision of these TOS is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. The invalid or unenforceable provision will be deemed modified to the extent necessary to make it valid and enforceable, or if that is not possible, replaced with a valid and enforceable provision that most closely matches the intent of the original provision.
18. Waiver
No waiver of any term or condition of these TOS shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and any failure to assert a right or provision under these TOS shall not constitute a waiver of such right or provision.
19. Assignment
Spybox may assign or transfer its rights and obligations under these TOS without restriction. Users may not assign or transfer their rights or obligations under these TOS without the prior written consent of Spybox.
